1music Terms and Conditions
(Dated May 2001)

All orders are accepted by 1music on these conditions of sale
which supersede all previous 1music terms and conditions.

These conditions of sale override and exclude any other terms
stipulated or incorporated or reffered to by the Customer,
whether in the purchase order or during any negotiations or any
course of dealing established between 1music and the Customer,
and constitute the entire understanding between 1music and the
Customer for the sale of products.

1music reserve the right to alter these conditions at any time without prior notice.
All goods including music samples available for download are subject to
copyright laws where applicable unless specifically excluded.

Pricing
  • 1music reserves the right to alter prices without notification.
Samples
  • Samples not described as preview samples shall be taken from
    the final product which is offered for sale.
  • All samples available for download are intended merely to present
    a general idea of the artist's music and
    nothing contained in any of them shall form part of the contract between
    1music and the Customer.
  • Samples described as preview samples might not bear any relation to
    the final product.
Orders
  • 1music does not impose any minimum order conditions.
  • All orders which are supplied by post are subject to postage,
    packing and handling charges.
  • 1music reserve the right to deliver part orders or hold orders
    until all items are available as required.
  • Delivery is subject to availability.
  • No order may be cancelled.
Returns
  • No goods can be returned to 1music without express consent from 1music.
  • Only faulty or incorrectly supplied goods may be returned to 1music
    for replacement.
Transit and Inspection
  • 1music cannot accept responsibilty for any loss or damage to goods
    in transit, or loss of Customer orders sent to 1music.
  • All goods are mailed at the Customers own risk.
  • The Customer must inspect the goods as soon as reasonably
    practicable after delivery and shall within 7 working days
    of such delivery give notice to 1music in detail of any defect in the
    goods or any other complaint which the Customer
    may wish to make about 1music's service.
Music Available for Download
  • Copyright laws apply to all music available from 1music unless
    specifically excluded.
  • The Customer is not permitted to sell copies of  music which
    he/she/it has obtained from 1music.
  • 1music cannot be held responsible for the loss or damage to
    any music which the Customer has downloaded from 1music.
Payment
  • Orders will not be shipped until payment is received.
  • If a Customer payment is rejected by the bank for any reason the
    Customer will be liable for the costs incurred by 1music.
    1music shall charge the Customer an administration fee for any
    legal or other actions required to recover monies due.
    1music shall charge interest on any monies due from the due date
    at a rate of 4% above the current London Interbank borrowing rate per annum.
Law
  • Any sales transacted by 1music or any of it's agents are governed
    solely by English law and the parties submit
    to the exclusive jurisdiction of the English courts.
Export Conditions of Sale for Non EU Customers
  • The above UK conditions of sale also apply to export orders.
  • In addition the following clauses also apply to orders received by
    1music from Customers outside the United Kingdom.
  • All duties, importation, and other costs related to import legislation
    in the destination country are the responsibility of the Customer.
  • The Customer shall indemnify 1music or it's agents against any
    expenses or losses incurred by 1music or it's agents in connection
    with the importation of goods into the destination country.
  • The Customer is responsible for obtaining any necessary import licences.
